Supreme Court of New England
The Supreme Court of New England is the highest court in New England. It was created by Article IV of the Constitution. The court has both original and appellate jurisdiction, the power of judicial review over laws passed by the Parliament of New England and interprets the Constitution of New England.
The Supreme Court only sits in Armidale, although it will often allow a closed-circut television link up from other parts of the country. The current Supreme Court building was constructed in 2014 and is located near Parliament Hill.
Powers & Functions
The Supreme Court also has the power of constitutional review, which is heard through the Constitutional Affairs Committee. Challenges to the validity of statute or common law can be made to the Committee. It consists of the three justices of the Supreme Court, as well as a Special Counsel, who assists the justices in the proceedings.
The Supreme Court also consists of the Court of Appeal. The court is the final avenue for appeal, and will only hear the most extreme or compelling of cases. The court requires the appellant to move for leave to appeal before it will hear the case, and as such the court has the discretion to grant or refuse the appellant's demand to appeal the lower court decision.
