Article Five
82. There shall be subdivisions in the Kingdom for the purpose of local administration of the State. These subdivisions shall be known as Counties.
83. The right of the counties to manage their own affairs independently, under the supervision of the Parliament, shall be laid down by statute.
84. Counties shall be administered by a county council, and be run by elected members known as Aldermen of the counties. The aldermen shall be elected directly by the people using an electoral system set down by the parliament. Unless Parliament otherwise provides, there shall six aldermen per county.
85. From amongst the elected aldermen of each county, there shall be one member elected to the office of Earl of the county in a method to be determined by the parliament.
86. The counties shall, subject to this Constitution, have power to make laws for the peace, order, and good government of the Kingdom with respect to: -
86.1 Local roads and thoroughfares not specifically noted by the parliament and all signage and fencing for these thoroughfares;
86.2 Water supply and management;
86.3 Garbage collection, recycling and storage;
86.4 Waste water management and recycling;
86.5 Pre-schools and day care centres;
86.6 Building ordinances and planning authority except lands reserved for the authority of the parliament;
86.7 Inspection of building sites for compliance with environmental laws and by-laws;
86.8 All public space not reserved for the authority of the parliament;
86.9 Flood prevention and drainage;
86.10 Weeds control and all noxious pest management;
86.11 Surf lifesaving and rescue;
86.12 Marinas and boat sheds outside those reserved for the authority of the parliament;
86.13 All aerodromes and airfields except those reserved for the authority of the parliament.
87. When a by-law of a county is inconsistent with a law of the Kingdom, the latter shall prevail, and the former shall, to the extent of the inconsistency, be invalid.
88. A county shall not impose any tax on property of any kind, and may only levy fees for any service provided.
89. Full faith and credit shall be given, throughout the Kingdom to the by-laws and the public records of every county.
